Status Report has been filed by the State, and the operative portion of status report, is set out below:
"...That, it is pertinent to mention here that as per circular issued by the competent authority i.e. Director General (Prisons), Tihar, New Delhi vide File No.10(003812004)/Legal/2025/7760-7777 Dated 14.11.2025 "there are two Semi Open Jails, One at Tihar and other at Mandoli. Semi Open Jail, Tihar has a sanction capacity of 48 convicts and Semi Open Jail Mandoli can accommodate 25 convicts. In the coordination meeting held on 12.11.2025, it has been brought to the notice of the Competent Authority that Semi Open Jail and Open Jail located in Tihar premises have been declared partially inhabitable and dangerous respectively by the PWD authorities and necessary repairs/renovations are currently underway in the Semi Open Jail / Open Jail premises to make it habitable.
Further, Semi Open Jail at Mandoli complex can accommodate 25 convicts and is running on its full capacity as 38 convicts have been ordered to be lodged in Semi Open Jail at The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

In view of the above statements, the learned counsel appearing for the petitioner, at this stage, seeks permission to withdraw the present petition with liberty to file afresh in case the need so arises. 3.
Accordingly, the present petition stands dismissed as withdrawn, with liberty as prayed for.
