This application has been filed under Section 438 of the Code of Criminal Procedure, 1973 (in short, 'Cr.P.C.') praying for the applicant to be released on anticipatory bail in FIR No. RCBD1/2020/E/0010 dated 23.12.2020 registered at Police Station: CBI, BSFB, New Delhi under Sections 120B/420/467/468/471 of the Indian Penal Code, 1860 (in short, 'IPC') and Section 13(2) read with Section 13(1) (d) of the Prevention of Corruption Act, 1988. 2.

The applicant was granted interim protection vide Order dated 07.02.2024, directing that no coercive action be taken against the applicant till the next date of hearing. The learned counsel for the respondent submits that the Charge Sheet already stands filed, and the applicant has been named as an accused in the same.

Keeping in view the fact that during the period of investigation, the applicant was not taken into custody and was, thereafter, granted an interim protection by this Court vide Order dated 07.02.2024, and also keeping in mind the principle enunciated by the Supreme Court in Satender Kumar Antil v. Central Bureau of Investigation Anr., (2022) 10 SCC 51, it is directed that the interim protection shall continue unless the learned Magistrate/Trial Court taking cognizance of the Charge Sheet deems it necessary for the applicant to be taken into custody for any reason.

The application is disposed of in the above terms. The pending application also stands disposed of.
