The petitioner seeks quashing of FIR No. 399 of 2014 under Sections 406/420/506/34 of the IPC Police Station Sagar Pur (South-West District), New Delhi, based on a settlement.

Learned counsels for the parties submit that the parties have settled their disputes and a memorandum of settlement dated 09.01.2018 has been executed. As per agreement, the petitioner had to pay a sum of Rs. 4,41,000/- to respondent no. 2. The entire amount already stands paid. Respondent no. 2 is agreeable to the settlement. 3.

Respondent no. 2 is present in person in Court today, represented by his counsel and is identified by the Investigating Officer. He submits that he has settled the disputes with the intervention of locals and respectable people of the locality. He further submits that he does not wish to press the CRL.M.C. 371/2018

criminal complaint against petitioners any further. 4.

In view of the fact that the disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.

In view of the above, the petitions are allowed. FIR No. 399 of 2014 under Sections 406/420/506/34 of the IPC Police Station Sagar Pur (South-West District), New Delhi and the consequent proceedings emanating therefrom are, accordingly quashed. 6.
