Petitioners are defendant nos. 3 & 4 before the learned Trial Court and have challenged order dated 09.01.2025 whereby one application filed by the plaintiff under Order XI Rule 1 (4) CPC was allowed.

It has now been divulged that when the suit was taken up by the learned Trial Court on 21.04.2025, suit with respect to one aspect has been decreed against defendant nos. 1 & 2 but with respect to another aspect, the matter has been referred for Arbitration in terms of Section 8 of Arbitration and Conciliation. He submits that in view of the above development, petitioners are no longer interested in pursuing with the present petition. It is, however submitted that in case the aforesaid order dated 21.04.2025 is, eventually, set aside, petitioners may be granted permission to revive the present petition. 3.

Copy of order dated 21.04.2025 has been shown and retained on record. 4.

In view of the above, present petition is disposed of as not pressed. 5.

Liberty, as prayed for, is granted.
