This is a petition under Article 227 of the Constitution of India seeking directions to the Family Court for expediting/disposal of the application under Section 12 of the Guardianship and Wards Act, 1890 ['the Act'] filed in the petition under Section 25 of the Act in case No. 61/2024. 2.

Learned counsel submits that minor child is in custody of the father, and therefore, the petitioner filed an application under Section 12 of the Act but the learned trial Court dismissed her early hearing application on the ground that respondent had not been not served. already appeared before the trial Court on 18.11.2024. 3.

Keeping in view the entire facts and circumstances, the petition is disposed of with directions to the learned trial Court to take up the application under Section 12 of the Act for consideration on the date fixed and after seeking reply and hearing both sides, make an endeavour to dispose of the application at the earliest. Counsels for both parties are also requested to render their due cooperation to the trial Court for the early disposal of the application.
