The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereafter „BNSS‟) has been filed on behalf of the petitioner, seeking quashing of the impugned order dated 16.12.2024 passed by the learned District and Sessions Judge, East District, Karkardooma Courts, Delhi, vide which the application of the petitioner herein seeking exemption from personal appearance was declined and vide order dated 27.01.2025, application seeking cancellation of non-bailable warrants and restoration of surety bonds was dismissed.

The Trial Court Record has been perused.

The accused in this case has been appearing regularly before the learned Trial Court except on 07.12.2024 and 16.12.2024 when his exemption application from personal appearance had been moved. on 16.12.2024, the learned counsel for the accused was present before the learned Trial Court. There is nothing to suggest from the learned Trial Court record that the day, on which, non-bailable warrants were issued against the accused, the counsel for the accused had sought adjournment or was absent. 5.

Considering the overall facts and circumstances of the case, nonbailable warrants issued against the accused stand cancelled. 6.

Accordingly, the present petition stands disposed of. 7.
