By way of the present petition, the petitioner seeks quashing of FIR bearing No. 60/2018, registered at Police Station Gulabi Bagh, Central District, New Delhi, for the commission of offences punishable under Sections 406 of the Indian Penal Code, 1860 (hereafter 'IPC') and the proceedings arising out of the said FIR.

Issue notice. The learned APP accepts notice on behalf of the State. 3.

The petitioner and respondent no. 2 are present before this Court and have been identified by their counsel and Investigating Officer (IO) concerned from Police Station Gulabi Bagh, Central District, New Delhi. Brief facts of the present case are that in the month of June-July 2017, respondent no. 2, NKS Hospital had approached the petitioner for procurement of a 160 KVA generator set. Upon negotiations, an order was placed subject to the agreed condition that full payment would be made prior to dispatch. However, in October 2017, respondent No. 2 withdrew from the transaction and sought refund of the advance amount. The petitioner expressed inability to refund the entire amount in a single transaction but assured repayment by December 2017 and, accordingly, refunded ₹1,40,000 in November 2017. Thereafter, respondent no. 2 had renewed its interest in purchasing a 200 KVA generator set, and negotiations resumed. Vide email dated 15.01.2018, the petitioner requested payment in terms of the quotation alongwith confirmation for dispatch.

However, on 10.06.2019, pursuant to a telephonic intimation from a police official, the petitioner had appeared at Police Station Gulabi Bagh, where representatives of respondent no. 2 were present. They declined to proceed with the transaction and demanded refund of the balance amount, which the petitioner immediately remitted in full. The SHO thereafter informed the Petitioner that the complaint stood resolved and no further action was required. Subsequently, the petitioner had received calls and WhatsApp messages from a Sub-Inspector alleging that the petitioner is wanted in connection with an FIR and was evading investigation, accompanied by threats, despite no notice being served in accordance with law.

This court has been informed that the parties have now amicably settled their disputes.

categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat and that he has received the entire amount due towards the petitioner. Therefore, he has no objection if the FIR is quashed.

In view of the above, that the parties have amicably resolved their differences of their own free will, and without any coercion, and no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 8.

Accordingly, FIR bearing No. 60/2018, registered at Police Station Gulabi Bagh, Central District, New Delhi, for the commission of offences punishable under Sections 406 of IPC and all consequential proceedings emanating therefrom are quashed.

In view of above, the present petition stands disposed of. 10.
