This is a petition under Section 528 of the BNSS (Section 482 of the Cr.P.C.) seeks quashing of FIR No. 48/2023, under Sections 384/34 of the IPC, registered as P.S. Cyber Police Station Rohini and all the other consequential proceedings emanating therefrom including the chargesheet pending before the court of concerned Learned Trial Court. 4.

have since compromised their disputes with respondents no. 2 vide settlement deed dated 25.01.2025 as per which respondent no. 2 has no objection if the present FIR is quashed against the present petitioners. 5.

Copy of the settlement deed dated 25.01.2025, has been placed on record, which records the settlement between the parties. 6.

The Complainant/respondent No.2 is present in person alongwith her father/Mr. J states that the matter has been settled with the petitioners and she has no objection if the FIR is quashed against the petitioners. She further states that all the terms of the settlement have been complied with and the said deed has been entered into with the petitioners without any pressure. 7.

The petitioners and respondent no. 2 are present before the Court and have been duly identified by their respective counsels, as well as the Investigating Officer, SI Ankit Yadav, Cyber Police Station Rohini. 8.

Learned APP for the State submits that investigation in the present FIR has been completed and chargesheet has been filed. 9.

In Gian Singh v. State of Punjab, (2012) 10 SCC 303, the Hon'ble Supreme Court has recognized the need of amicable resolution of disputes by observing as under:- "61. ... In other words, the High Court must consider whether it would be unfair or contrary to the interest of justice to continue with the criminal proceedings or continuation of criminal proceedings would tantamount to abuse of process of law despite settlement and compromise between the victim and the wrongdoer and whether to secure the ends of justice, it is appropriate that criminal case is put to an end and if the answer to the above question(s) is in the affirmative, the High Court shall be well within its jurisdiction to quash the criminal proceeding."

put a quietus to the dispute, no useful purpose will be served in continuing with the present FIR No. 48/2023, under Sections 384/34 of the IPC, registered as P.S. In the interest of justice, the petition is allowed, and the FIR No. 48/2023, under Sections 384/34 of the IPC, registered as P.S. Cyber Police Station Rohini and all the other consequential proceedings emanating therefrom including the chargesheet pending before the court of concerned Learned Trial Court, is hereby quashed, subject to cost of Rs. 15,000/- each to be paid by the petitioners. The said amount shall be deposited as a consolidated sum of Rs. 30,000/- with Delhi High Court Employees Welfare Fund within 10 days from today.
