Criminal Miscellaneous Petition under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.PC')/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.'), has been filed on behalf of the Petitioner, Net Ram Soni for quashing of FIR No.0235/2017 dated 22.07.2017 under Section 354/506 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Hauz Khas, District-South (Delhi) and all the consequential proceedings emanating therefrom, on account of the Settlement inter se the parties.

On advance Notice, learned APP for the State has appeared and accepts the Notice on behalf of the State.

The Complainant, who is present in the Court, submits that she was working as an Executive in the same Company where the Petitioner was working as AGM. She further submits that she has got married and had left the job and stays in another State and therefore, is not inclined to continue with the present FIR.

On the Complaint of the Respondent No.2/Complainant, FIR No.0235/2017 dated 22.07.2017 under Section 354/506 IPC, got registered at Police Station Hauz Khas, District-South (Delhi). On 14.09.2017, ChargeSheet has been filed by the SI at Police Station Hauz Khas, against the Petitioner.

With the kind intervention of common friends and elders, as well as, the respectable people of the franternity, the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide No Objection Certificate/Affdiavit dated 08.01.2025, given by the Complainant. It is settled between the parties that the Petitioner shall pay a sum of Rs.2,00,000/- towards full and final settlement of all the claims of the Respondent No. 2/Complainant. 7.
Today, the Respondent No. 2, who is present in the Court, states that she has received all amounts due to her and has no objection if the said FIR is quashed.

The parties have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.
