Petitioners seek quashing of case FIR No. 165/2025 of PS Madhu Vihar, Delhi for offence under Section 106(1)/281 BNS on the ground that the legal heir (respondent no.2) of the deceased has compromised the disputes with them.

It appears that wife of respondent no.2 succumbed to injuries sustained in a roadside accident, caused by a motorcycle being driven by petitioner no.2 and owned by petitioner no.1, who had not got the motorcycle insured.

Firstly, not getting the motorcycle insured is not a private offence, which can be compromised. Secondly, allowing compromise in such a situation would tantamount to sanctifying blood money, not recognized by any civilized society across the world. For, it is the deceased who suffered pain and loss of life on account of the accident. Learned counsel for petitioners, at this stage, seeks permission to withdraw the petition. As requested, the petition and the accompanying application are dismissed as withdrawn.
