The present petition is filed under Section 11 of the Arbitration and Conciliation Act, 1996 (for short 'the Act') for appointment of an arbitrator. 2.

The facts in brief are that the petitioner was awarded a commercial leasing contract by the Respondent pursuant to an e-auction conducted on the IREPS Portal, vide contract dated 25.03.2025 for leasing of F-1 compartment of Train no. 12314 (NDLS-SDAH) for a period of two years. Dispute arose between the parties to the lis, due to termination of the contract vide letter dated15.12.2025, and forfeiting the Security Deposit and imposing a monetary penalty. The arbitration clause 22 of the agreement provided for dispute resolution through arbitration. The arbitration clause of the agreements was invoked at the instance of the petitioner by serving notice dated 17.12.2025 under Section 21 of the Act. Hence the present petition.

for referring the matter to arbitration.

Accordingly, the petition is allowed by appointing Justice Mr. V. K. Jain (Retd.) (Mobile No.9650116555) as the sole arbitrator for adjudication of the disputes which have arisen between the parties. 5.

The fees of the learned Arbitrator will be governed by Schedule IV of the Act. Before entering upon reference, the learned Arbitrator will comply with Section 12 of the Act.

It is made clear that since this Court has not expressed any opinion on the merits of the rival claims of the parties, it will be open for the parties to file their respective claims/counter claims before the learned Arbitrator which will be considered in accordance with law. 7.

A copy of this order be forwarded to the learned Arbitrator for information.
