The instant application under Section 439 read with Section 482 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been filed on behalf of applicant seeking grant of interim bail in case FIR bearing no. 15/2023, registered at Police Station North Rohini, Delhi for the offences punishable under Sections 376/377/328/506 of the Indian Penal Code, 1860 ('IPC'). 2.

Issue notice. Mr. Naresh Kumar Chahar, learned APP accepts notice on behalf of State.

Learned counsel for the accused/applicant submits that the applicant seeks grant of interim bail for a period of 15 days to attend marriage of his niece which is scheduled for 16.02.2024. It is stated that the applicant is the only maternal uncle of his niece, whose marriage has been fixed for 16.02.2024. Learned APP for the State argues that prosecutrix in this case is yet to be examined and that a complaint had been received regarding threats being extended to the complainant by the family members and accused herein, who was a sub-Inspector in Uttar Pradesh police. 5.

I have heard arguments addressed by both the parties and have gone through the material on record.

This Court, yesterday as well as today, made an inquiry from the Investigating Officer (IO) as to whether the factum of the complaint which was received on 27.01.2024 has been verified or not, However, the IO states that verification of the said complaint has yet not be carried out. 7.

The factum of marriage of the niece of the applicant has been verified by the prosecution which is to take place at Meerut, Uttar Pradesh. 8.

The accused has been in judicial custody since his arrest on 03.03.2023. Considering the overall facts and circumstances of the case, this Court is inclined to grant interim bail to the applicant for four (04) days on his furnishing a personal bond Rs. 20,000/- with two sureties of the like amount to the satisfaction of the learned Trial Court, Successor Court, Link Court, Duty Judge concerned. The accused be released on 14.02.2024 and he will surrender on 18.02.2024 without seeking any extension of interim bail granted to him on any ground, on the following conditions: (i) The applicant will not approach the prosecutrix or any other person of her family, and will not visit the vicinity of the house of prosecutrix.

(ii) The applicant will not try to threaten the witnesses. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

(iii) If the applicant has passport, he will surrender it to the court concerned and will not leave the country during the period of interim bail.

(iv) The applicant shall share his mobile number with the IO/SHO concerned which shall be kept operational at all times. 9.

Accordingly, the present application stands disposed of. 10.
