The present petition under Article 227 of the Constitution of India read with Section 151 of the Code of Civil Procedure, 1908 has been filed impugning the order dated 03.10.2023 passed by the learned District Judge (Commercial Court-03), Patiala House Courts, New Delhi in CS Comm. No. 345/2022 titled as "Surender Singh Sethi vs. Ranjana Bhasin & Ors." whereby the application filed by the defendant no. 1 under Order IX Rule 7 read with Section 151 Code of Civil Procedure, 1908 and application under Section 8(1) of the Arbitration & Conciliation Act, 1996 was dismissed. 2.

Learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file afresh as there are certain technical and typographical defects in the present petition.
