Applicant seeks regular bail in a case arising out of FIR No. 804/2025 dated 25.10.2025, registered at Police Station Adarsh Nagar, under Section 75(1) of Bharatiya Nyaya Sanhita, 2023 (corresponding Section 354A IPC) and Section 10 of Protection of Children from Sexual Offences (POCSO) Act, 2012.

The applicant had earlier filed an application seeking anticipatory bail. Fact, however, he himself surrendered before the concerned Court on 14.01.2026 and is in custody since then.

Allegations against him are captured in abovesaid FIR and as per the case of prosecution, accused/applicant had allegedly kissed on the cheek of the prosecutrix, aged 11 years.

Applicant is, reportedly, around 29 years of age, with no previous involvement of any nature whatsoever.

Azadpur area and since the prosecutrix is also residing in the immediate neighbourhood, learned counsel for applicant, on the instructions of father of applicant, submits that it shall be ensured that after his release, the applicant would stay elsewhere.

In view of the above and keeping in mind the overall facts and circumstances and the fact that investigational aspect is already over, applicant is admitted to bail on his furnishing personal bond and surety bond in a sum of Rs. 20,000/- each subject to the satisfaction of concerned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class with the following conditions: - (i) Applicant shall not come in the vicinity, where prosecutrix is residing, till her evidence is recorded.

(ii) Applicant shall not try to contact, influence or threaten any witness, directly or indirectly.

(iii) He would provide his Mobile Number to the concerned I.O and would ensure that such Mobile Number remains active and operational, till the disposal of the case by the learned Trial Court.

Application stands disposed of in aforesaid terms. 8.
