At the outset, Mr. Sanjeev Sabharwal, learned APP for State, on instructions from the I.O., submits that the appellant has already preferred an appeal against the impugned judgment of conviction dated 25.04.2023 and order on sentence dated 24.07.2023 vide Criminal Appeal No.1075/2023. He states that the aforesaid appeal came up for consideration on 21.12.2023, wherein the appeal came to be admitted and notice was directed to be issued. Further, the application for suspension of sentence was put up on 15.02.2024.

Considering that the appellant has already filed the aforesaid appeal against the impugned judgment and order on sentence, the present appeal has become infructuous and the same is disposed of as such. 3.

Let a copy of this order be communicated to the appellant through the concerned Jail Superintendent.
