O R D E R

The present application has been filed under Section 151 of the Code of Civil Procedure, 1908 ("CPC") on behalf of the plaintiff as well as the defendants.

disputes and a Settlement Agreement dated 09th April, 2026, as entered between the parties has also been placed on record before this Court. th 3.

It is submitted that according to the Settlement Agreement dated 09 April, 2026, both the parties to the suit have agreed to cancel/terminate the Agreement to Sell dated 07th October, 2025, entered into between all the parties in the suit, in respect of suit property bearing no. 3188-A/232, situated at Chander Nagar, Tri Nagar, Delhi-110035. 4.

Further, the defendants agree and undertake to return/refund the amount of Rs. 23,50,000/- that had been received by the defendants from the plaintiff by way of three different bank drafts, towards full and final settlement of all claims.

Today, the three demand drafts amounting to Rs. 23,50,000/- have been returned by learned counsel appearing for the defendants to learned counsel appearing for the plaintiff, for handing over to the plaintiff, before this Court.

This Court is also informed that the plaintiff has withdrawn the police complaint dated 27th January, 2026 that had been filed against the defendants at Police Station, Keshav Puram, New Delhi. 7.

Thus, learned counsel appearing for the plaintiff submits that in view th of the Settlement Agreement dated 09 April, 2026, he shall withdraw the present suit.

Learned counsels appearing for the parties as well as the parties in person are present before this Court. They confirm that the Settlement Agreement has been entered into out of volition and without any coercion. 9.

Accordingly, the plaintiff is allowed to withdraw the present suit. 10.

The present suit is dismissed as withdrawn.

The pending applications also stand disposed of. 12.

The next date of hearings of 21st May, 2026 and 08th July, 2026, stand cancelled.
