% 05.02.2020 The matter has been placed before this Court by the learned Joint Registrar (Judicial).

On behalf of the appellant, reliance has inter alia been placed on the verdict of the Hon'ble Supreme Court in "State of U.P. Vs. Abhai Raj Singh and Another" (2004) 4 Supreme Court Cases 6 as well as on the verdict of the Hon'ble High Court of Bombay in "Akalesh Kumar @ Mithun Sharad Mishra Vs. The State of Maharashtra" 2010 SCC OnLine BOM 390 seeking acquittal on the premise of the non reconstruction of the entire Trial Court Record, the said aspect would be considered when arguments are addressed. The Trial Court Record has apparently been reconstructed to the extent possible. In view thereof, the matter be re-notified for arguments on the appeal for the date 21.04.2020. The appellant is directed to be present on the next date of

hearing.

The copy of the reconstructed Trial Court Record to the extent that it has been so reconstructed be supplied to the State in the e-form by the Registry.
