The present writ petition has been filed seeking a direction to respondents no.1 to 5 to take appropriate action for removal/ demolition of unauthorized construction carried out by the respondent no.6 at 374-375, Bazar Delhi Gate, Daryaganj, Delhi - 110002.

Mr. Kapil Dutta, counsel appearing on behalf of the respondent/ MCD on advance notice, submits that the aforesaid property was inspected on 20th January, 2026 and it was noticed that unauthorized construction is being carried out.

He submits that the property has been booked on 20th January, 2026 and a Show Cause Notice has been issued. Subsequently, a 'work stop notice' has also been issued on 21st January, 2026 to SHO (P.S. the subject property.

Taking the aforesaid submissions on record, the present writ petition is disposed of while directing the respondent/ MCD to take action in accordance with law.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

All rights, contentions and legal remedies of the respondent no.6 shall remain protected.
