The present matter has been listed for hearing today on account of 05.02.2025 being declared as a holiday of the Court, pursuant to Office Order dated 31.01.2025 bearing No. 04/IG-4/Gen.-I/DHC. 2.
This petition has been filed under Article 226 of the Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) seeking quashing of FIR No. 13/2023 under Sections 420, 467, 468 and 471 of Indian Penal Code, 1860 ('IPC') registered at Police Station (P.S) Saket.

Learned ASC for Respondent No. 1-State submits that the present FIR was registered on the complaint of Ms. Sunaina Singh i.e., the Respondent The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
No.2 herein wherein she alleged that her father Sh. Deepinder Singh i.e., the Petitioner No.1 herein has filed a Probate Case No. 4/2019 titled as 'Deepinder Singh Vs State & Ors.' before the Court of Ld. ADJ, Saket Court (South), New Delhi. And in the said suit, her father has propounded a false, fabricated and forged Will dated 04.10.2008 of her grandfather Lt. Sh. Devinder Singh Chaudhary.

He states that during investigation, the result from the RFSL/Chanakyapuri has been received and it is revealed that the Will dated 04.10.2008 procured from the Court of Ld. ADJ was a coloured copy. He states the RFSL has opined as under:- a. The signature of Lt. Sh. Devinder Singh (executor) and Lt. V.K. Singhal (witness) does not match with their admitted signatures. b. No opinion is possible about the signatures of Sh. Mahipal Singh (witness.) c. No opinion is possible about the signatures of Lt. Sh. P. Vijayan (witness) due to poor quality of his signatures in Xerox copy. d. The signatures of Smt. Sita Chaudhary on additional settlement matched with her admitted signature executed in the year 2019 & 2021.

He states that charge-sheet since stands filed on 24.09.2024 and the matter is next listed for framing of charges before the Trial Court on 12.02.2025.

In light of the findings FSL Report dated 19.07.2023, this Court finds no merit in the present petition seeking quashing of the FIR and the petition is dismissed.
