CRL.M.A. 15362/2026 By way of the present application filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner/applicant seeks a direction to respondent No.1 to register an FIR and carry-out investigation in the matter, with a further direction to collect and preserve evidence in the matter at the earliest. 2.

Ms. Harpreet Kalsi, learned counsel appearing for the petitioner submits, that it was the petitioner's contention that a settlement agreement filed by respondent No.5 in the present proceedings, was a forged document, based on which vidé order dated 02.08.2024, the learned Predecessor Bench passed the following directions : The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Accordingly, the original of the said settlement agreement was directed to be produced by Respondent No. 5 to the Investigating Officer. The Petitioner was also directed to file an affidavit as to whether the said agreement had been executed by him or not and the matter was adjourned to 16.05.2024. On 16.05.2024 this Court was informed that the original settlement agreement has been handed-over to the Investigating Officer. "6. Before proceeding further it is necessary to ascertain the veracity of the settlement agreement.

The Investigating Officer is directed to obtain the signatures of the Petitioner and the Respondent No.5 and send the settlement agreement and the signatures of the Petitioner herein and the Respondent No.5 to the concerned FSL to ascertain as to whether the settlement agreement was executed by the Petitioner and Respondent No.5 or not.

"8. Since the matter pertains to a forged document which has been filed before this Court, therefore, looking at the seriousness of the matter the concerned FSL is directed to give its opinion on the alleged settlement agreement within six weeks from today."

Ms. Kalsi submits, that further to the steps that were taken pursuant to order dated 02.08.2024, the FSL report has been received which confirms that the settlement agreement was forged. 4.

Ms. Kalsi draws attention to status report dated 12.11.2025 filed in the matter in support of that submission.

In the circumstances, counsel submits, that the present matter may be disposed-of by issuing the directions as prayed-for in the present application.

Mr. Kshitiz Garg, learned counsel appears on behalf of Mr. Amol Sinha, learned ASC for the State on advance copy; accepts notice; and confirms that the FSL report has opined that the settlement agreement filed and relied-upon by respondent No.5 was forged. 8.

In the circumstances, the present application is disposed-of directing respondents Nos.1 and 2 to register an FIR against the concerned parties and to investigate the matter, in accordance with law, including by collecting and preserving the evidence in the matter expeditiously. 9.

In view of the above, the petition stands disposed-of.

10. Pending applications, if any, also stand disposed-of.
