The present matter was listed on 23.02.2024 and on that date, this Court passed the following order:- "1.

The petitioner has filed the present petition impugning an award (Award No. 06/2020/SW) dated 25.09.2020.

The petitioner does not challenge the acquisition of the land in question (Khasra No.636 Min. admeasuring 0.0832 acres). However, he claims that he is entitled to rehabilitation and compensation in respect of his land located in the said Khasra.

Admittedly, the petitioner is not the recorded owner of the said land. The same is recorded in the name of the Government / Gram Sabha and the nature of the land is described as agriculture.

there were several other persons who had raised claims in respect of their lands in the said Khasra which were considered and compensation has been awarded to them. He claims that he is also similarly placed as the said claimants.

Mr. Pathak, learned counsel appearing for respondents no.2 and 3 controverts the same. He submits that although the impugned award dated 25.09.2020 records that claims have been received from certain persons but no compensation has been awarded to them.

4. On our query as to who are the claimants whose claims for compensation have been allowed; the learned counsel appearing for the petitioner requests for some time to examine the same and seeks an adjournment.

At the request of the learned counsel appearing for the petitioner, list on 27.02.2024."

The learned counsel for the petitioner seeks to withdraw the present petition with liberty to avail other remedies, if otherwise available, in accordance with law.

The petition is dismissed as withdrawn with the aforesaid liberty. Pending application also stands disposed of.
