could have remanded the accused persons while exercising his power under Section 309 of the Code of Criminal Procedure, 1973, when the cognizance has not been taken, making the order of remand itself as illegal, he will withdraw the present applications at this stage and file subsequently. 2.
The present applications are dismissed as withdrawn with the aforesaid liberty.
