O R D E R

% 16.02.2024 1.

The present application is filed, under Section 439 of the Code of Criminal Procedure, 1973 (CrPC), seeking grant of interim bail in FIR No. 269/2017 dated 22.08.2017, for the offence under Section 307 of the Indian Penal Code, 1860 ('IPC'), registered at Police Station Khyala. Chargesheet has been filed against the applicant for the offences under Sections 302/324/120B/34 of the IPC.

The learned Additional Public Prosecutor submits, on instructions, that it is verified that the marriage of the brother of the applicant is fixed for 19.02.2024.

The applicant is in incarceration since 24.08.2017. 4.

It is not denied that when the applicant was granted interim bail on an earlier occasion, he did not misuse the liberty and had surrendered on the expiry of the interim bail. In view of the above, the present application is allowed and the applicant is directed to be released on interim bail for a period of six days on furnishing a bail bond for a sum of ₹20,000/- with two sureties of the like amount, subject to the satisfaction of the Jail Superintendent, on the following conditions:

a.One of the surety bonds be given by the family of the applicant.

b.The applicant shall only travel outside Delhi for the limited purpose of attending the wedding of his brother, and he shall record his presence at the nearest police station (to be intimated by the concerned Investigating Officer) from the venue of the wedding, on the days he is outside Delhi; c.The applicant shall provide his mobile number to the concerned Investigating Officer, which shall be kept switched on at all times;

d.The applicant shall call the concerned Investigating Officer every day at 11 AM while he is on interim bail; e.The applicant shall not try to contact or influence any of the witnesses.

The applicant is directed to surrender on or before the seventh day of his release.
