O R D E R

% 06.10.2016 A report has been received from the District & Sessions Judge (East), Karkardooma Courts, Delhi, which shows that the appellant convict has already undergone the entire sentence and was released from jail upon completion of his sentence on 29.01.2006, i.e. during the pendency of the present appeal.

Endeavour to serve the appellant on account of his non-appearance have remained unfruitful. It appears that the appellant is not interested in pursuing the present appeal on account of the fact that he has already undergone the entire sentence.

In view of the judgment of the Supreme Court in Surya Baksh Singh Vs. State of U.P., (2014) 14 SCC 222, in my view, the present is a fit case for dismissal of appeal on account of non-appearance of the appellant and his counsel. The same is, accordingly, dismissed.
