By way of the present petition filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS'), the Petitioners, who are the husband and the in-laws of the Complainant/Respondent No. 2 seek quashing of the FIR No. 0293/2022 registered under Section 498A/406/34 of the Indian Penal Code, 1860 (IPC) registered at Police Station (P.S) Sarai Rohilla, Delhi, on the basis of Settlement Deed dated 14.02.2023 signed between the contesting parties.

Hon'ble the Chief Justice in relation to dealing with the petitions seeking quashing of FIR based on compromise, the learned Joint Registrar (Judicial) vide order dated 11.02.2025 has recorded that the parties have resolved their disputes and have in fact, agreed to amicably part ways. The decree of divorce dated 21.10.2023 passed by the Ld. Principal Judge, Family Court, Central District, Tis Hazari Court, Delhi has been placed on record. 3.

The statements of the contesting parties have also been recorded by the learned JR, copies of which have been appended to the order dated 11.02.2025.

In line with the law laid down by the Supreme Court in Gian Singh vs. State of Punjab & Anr. reported as (2012) 10 SCC 303 and also in Narinder Singh & Ors. vs. State of Punjab & Anr. reported as (2014) 6 SCC 466, this Court sees no reason why the subject FIR and all proceedings emanating therefrom should not be quashed. This Court is of the view that in the light of the above settlement between the contesting parties, continuing with the subject FIR and all subsequent proceedings would be an exercise in futility and would not be conducive to peace and harmony between the parties.

Accordingly, FIR No.

0293/2022 registered under Section 498A/406/34 of the Indian Penal Code, 1860 registered at Police Station Sarai Rohilla, Delhi is quashed and all proceedings emanating therefrom are quashed.

The Investigating Officer ('IO') is directed to apprise the Trial Court with respect to the quashing of the FIR.

Accordingly, Petition stands disposed off.
