% 30.05.2018 IA No.7598/2018 This application is filed under Order 23 Rule 1 CPC for withdrawal of the present suit. It has been pointed out that pursuant to proceedings before the Delhi High Court Mediation and Conciliation Centre the parties have voluntarily recorded a Settlement Agreement dated 24.5.2018.

The defendant has executed undertaking in two parts. One part has been handed over to the plaintiff and the second part is annexed to the Settlement Agreement as Annexure-B. Parties have agreed that the said undertaking shall be put in a sealed cover so as to keep its contents confidential. The application is allowed.

The undertaking which has been executed by the defendant as Annexure B to the Settlement Agreement before the Delhi High Court Mediation and Conciliation Centre shall be put in a sealed cover on receipt from the Mediation Centre by the concerned Assistant Registrar.

CS(OS) 8/2018 In view of the above, the suit is dismissed as withdrawn. The plaintiff shall be entitled to refund of the court fees. JAYANT NATH, J MAY 30, 2018 n
