% 04.10.2016 C.M.No.36371/2016 Present application has been filed for revival of the contempt petition and to proceed against the respondents for wilful disobedience of the Division Bench order dated 20th December, 2001 passed in W.P.(C) No.1611/2001.
On 23rd February, 2010, the contempt petition was disposed of with a direction that in case the respondent does not recruit teachers in any year or sits over the vacancies for long, the petitioner is at liberty to approach this Court.
In the opinion of this Court, the liberty granted would not mean revival of the present petition on fresh cause of action but on the facts
stated in the initial contempt petition.
Consequently, the present application is disposed of with liberty to the petitioner to file a fresh contempt petition. The rights and contentions of all the parties are left open. Order dasti under the signatures of Court Master. MANMOHAN, J OCTOBER 04, 2016 KA
