% 26.04.2018 This is a petition under Article 226 of the Constitution of India filed by the petitioner. The petitioner claims to be a regular street vendor and has been vending from near Azad General Store, Bhogal Road, Bhogal, New Delhi for the past many years. The petitioner alleges that he is being disturbed by the officials of the respondents, while hundreds of street vendors continued to vend undisturbed.
Mr. Gupta, learned counsel appearing on behalf of respondents no.1 and 2 submits that the area in question is a 'no-hawking' 'no-vending' zone. He submits that regular drives are conducted to remove the unauthorized street vendors, however, they return back. He further submits that pursuant to the orders passed by this Court on 20.09.2017, a joint meeting was convened by the Assistant Commissioner, SDMC(Central Zone) with ACP, Friends Colony and
ACP, Defence Colony and the MCD would adhere to the Minutes of the Meeting. Counsel for the respondents further submits that fresh rules of Delhi Street Vendors (Protection of Livelihood and Regulation of Street Vending) Rules 2017 have been notified on 10.01.2018 as also a public notice has been given calling upon the street vendors to furnish documents to enable the Corporation to prepare the electoral roll to conduct elections for the Town Vending Committee(TVC).
At this stage, learned counsel for the petitioner submits that the petitioner would approach the MCD and file all supporting documents and thereafter once the TVC is constituted, he would approach the TVC to grant him an appropriate site.
