Accordingly, the present application stands disposed of. W.P.(C) 2018/2024 and CM APPL. 8480/2024 1.

Present writ petition has been filed challenging the tender dated 18th December, 2023 issued by Respondent no. 2/RML Hospital for supply and replacement of lifts nos. 18 and 19 in Trauma Centre at RML Hospital on the ground that tender is restricted to limited makes/manufacturers/brands, which does not include the Petitioner.

Today learned counsel for the Respondent, on instructions, states that the Respondent has decided to cancel the tender. In view of the aforesaid letter, the present writ petition is closed as infructuous. However, the Respondent is directed to refund the earnest money deposit, bank guarantee as well as the tender fee, if any, received by it, in accordance with law, within four weeks.
