Heard the learned counsel for the parties.

Admittedly, against the order under challenged in this writ petition, a remedy of statutory appeal under Section 253(1)(C) of the Income Tax Act, 1961 is available. Hence, we are not inclined to entertain this writ petition, which is hereby disposed of with the liberty to the petitioner to approach the appellate authority to challenge the order.

We make it clear that all the pleas which are available to the petitioner shall be permissible to be taken by him, while filing the appeal. 4.
