The present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 482 of the Code of Criminal Procedure, 1973) seeks quashing of FIR No. 145/2018 registered under Sections 420/468/471/120B of Indian Penal Code, 18601 read with Section 12 of the Passport Act, 1976 at P.S., Crime Branch.

As per the status report filed by the State, the investigation is nearing its conclusion, and a chargesheet has been prepared but is yet to be filed. The status report reveals that none of the Petitioners are being chargesheeted.

Inspector Ashok Kumar, P.S., Cyber Cell, Crime Branch, states that the role of the Petitioners is still being ascertained and, as of date, there is no material available against them.

In light of the above developments, counsel for the Petitioner seeks permission to withdraw the present petition with liberty to take appropriate remedies, should the State take any steps to implicate the Petitioners in the future.

In light of the foregoing, the present petition is dismissed as withdrawn with liberty as aforesaid.
