% 17.02.2026 By way of the present petition filed under Article 226 of the constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks a direction to the respondents to withdraw e-mail dated 19.02.2024, whereby a 'debit-freeze' has been placed on the petitioner's bank account.
At the outset, Mr. Kshitiz Garg and Ms. Chavi Lazarus, learned counsel appearing on behalf of Mr. Amol Sinha, learned ASC for State submit, that the petitioner has a remedy under section 457 of the Code of Criminal Procedure, 1973 before the learned Magistrate, which however he has not invoked.
In the circumstances, the present petition is disposed-of, granting to the petitioner liberty to approach the learned Magistrate, seeking the same relief, as may be permissible, in accordance with law. Pending applications, if any, also stand disposed-of.
