The present writ petition has been filed seeking a direction to the respondent no.1/MCD to inspect the property bearing No. A-196, Gujrawala Town, Delhi-110009 and take action against the unauthorised construction being carried out by the respondent nos.4 to 7. 2.

It is stated that the petitioner is a co-owner of the aforesaid property and has already filed a civil suit for partition being CS(OS) 303/2019 which is pending before this Court and in which status quo order with regard to title and possession has been passed.

The grievance of the petitioner is with regard to unauthorised construction being carried out by the respondent nos.4 to 7. 4.

Issue notice.

Notice is accepted on behalf of counsel for the respondents. 6.

Counsel for the respondent no.1/MCD submits that a show cause notice has been issued to the owner/occupier of the property to which a reply has also been received.

In view thereof, the present writ petition is disposed of while directing the respondent no.1/MCD to take appropriate action in accordance with law in an expeditious manner.

In the event the petitioner has any further grievance with regard to unauthorised construction, she is at liberty to take appropriate remedies in accordance with law.

Needless to state, all rights and legal remedies of the private respondent nos.4 to 7 are kept open.
