% 16.02.2018 Petitioners are seeking quashing of the present FIR i.e. the FIR No.0135/2016 registered under Sections 498A/406/34 of the IPC at police station Chandni Mahal on the complaint of respondent no.2. Respondent no.2 is present in person. Her presence has been identified by the Investigating Officer. All the petitioners are also present in person. Petitioner no.1 and respondent no.2 got married as per their personal law on 17.12.2013. A female child was born who is presently in the custody of petitioner no.1. Parties have since been divorced according to their personal law. The matter has been compromised in the terms of the settlement arrived at between the parties. In terms of the aforenoted settlement a sum of ₹9,50,000/- has been paid by petitioner no.1 to the respondent no.2 in full and

final settlement of her all claims. Parties have now left nothing towards one another. Respondent no.2 has visitation rights to meet the child of the parties who will remain in the custody of petitioner no.1. Respondent no.2 shall always have visitation rights qua her child. It has been agreed that respondent no.2 will be afforded visitation rights for her child once in every week at a time to be agreed inter se the parties telephonically.

In view of the narration of facts, it is a fit case where the prayer made in the petition be granted. Accordingly, to secure ends of justice, FIR No.0135/2016 registered under Sections 498A/406/34 of the IPC at police station Chandni Mahal and all the proceedings emanating therefrom stand quashed.

Petition disposed of in the above terms.
