The present petition under Article 226 of the Constitution of India read with Section 482 of the CrPC seeks the following prayers:- "In view of the aforesaid facts and circumstances, it is most respectfully and humbly prayed that this Hon‟ble Court may be pleased to: (i) Allow the present petition and issue writ /order /direction in the nature of mandamus thereby directing the respondent to either grant of parole for a period of 2 months or extension of furlough for a period of 2 months, whichever deems fit and proper, in the facts and circumstances, in the interest of justice and equity.

(ii) Pass such other writ/order/direction as this Hon‟ble Court may deem fit and proper in the facts and circumstances of the present case, in the interest of justice & equity."

The petitioner appeared in person on the last date of hearing, i.e., on 13.02.2024 and handed over documents in relation to his wife‟s surgery to learned Additional Standing Counsel for the State for verification. Pursuant thereto, learned Additional Standing Counsel for the State has handed up in Court, status report dated 14.02.0224 authored by SHO, PS Punjabi Bagh wherein it is stated that the said documents have been verified. The said status report is taken on record. 4.

Learned Additional Standing Counsel for the State, on instructions, submits that the surgery of the petitioner‟s wife was postponed at request of the patient herself.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the present petition, with liberty to file a fresh application before the concerned authority, if the need arises, in accordance with law. 6.

Leave and liberty granted.

The present petition is dismissed as withdrawn and disposed of accordingly.

Pending applications, if any, also stand disposed of. 9.

In the meantime, the furlough granted to the petitioner is extended till 15.02.2024.

The petitioner shall surrender before the concerned Jail Authorities by 04:00 PM on 15.02.2024.

Order be communicated to the concerned Jail Superintendent for necessary information and compliance.
