O R D E R

% 09.02.2018 Vide the present petition, the petitioner has sought quashing of orders dated 27.11.2017 and 24.04.2017 passed by respondent Nos.1 and 2 respectively.

Learned counsel for the petitioner submits that the petitioner's request for recognition have been rejected on the ground that NOC from the affiliating body was submitted to respondent No.2 belatedly and not with the online application as required under the Regulations of the respondents. He submits that a similar petition has already been allowed by this Court in the case of Rambha College of Education vs. NCT and Ors., vide order dated 23.02.2017. In the said matter, the Court had after examining all the relevant regulations of the respondents, come to a conclusion that if the NOC from the

affiliating body is made available even at the appellate stage to respondent No.1, the same should be considered and recognition of the institute otherwise ought to be granted.

On the last date, Ms.Arora has sought time on the ground that the respondents have preferred an SLP against the said judgment. She fairly states that the SLP stands dismissed. In view of the same, the parties agree that the present case is squarely covered by the judgment of Rambha College of Education (supra).

Accordingly, the orders dated 27.11.2017 and 24.04.2017 passed by respondent Nos.1 and 2 respectively are quashed and the respondents are directed to process the application of the petitioner subject to the petitioner complying with all other requirements by ignoring the fact that the NOC for affiliation was submitted belatedly. In view of the fact that the 3rd March, 2018 is the last date for granting recognition, it is expected that the respondents would take expeditious steps to process the application of the petitioner. The writ petition is allowed with the aforesaid directions. The pending application also stands disposed of.
