This petition is filed on behalf of the Petitioners under Section 9 of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking restraint order against the Respondent from removing Pneumatic Tube System ('PTS') from the project site in Acharya Shree Bhikshu Government Hospital, Moti Nagar, Delhi, installed by the Petitioners. 2.

Genesis of this petition is a tender floated by the Respondent for expansion/remodelling work at the hospital, which included providing civil, horticulture and electrical services. Tender was awarded to the Petitioners and work commenced. PTS was installed by the Petitioners apart from rendering other services. regard to the installation of PTS, leading to the Petitioners filing the present petition for interim reliefs.

By order dated 19.02.2025, Court restrained the Respondent from taking any adverse/coercive action against the Petitioners including removal of PTS at the project site in question in the present petition and/or any other project of the Respondent. Interim order has continued till date. 4.

Mr. Kiran Babu Koneru, Executive Engineer, Public Works Department, Government of NCT of Delhi has joined Court proceedings virtually and submits that in terms of the order passed by this Court, Respondent has taken a conscious decision not to remove the PTS system at the project site. The statement is taken on record and accepted. Needless to state that the statement shall bind the Respondent. 5.

In light of the aforesaid stand of the Respondent, no further order is required to be passed and the petition stands disposed of with liberty to the Petitioners to take recourse to arbitration proceedings, if so advised.
