In the instant petition, the petitioner has challenged the provisional suspension order dated 13.02.2026 in relation to Contract No. BDA/ONSG/MM/Hiring/BN6AC23001/9030011821.

At the inception, it is noted that the petitioner is situated at Ahmedabad. petitioner was awarded a three year contract in the year 2023 for deployment of a drilling rig at CBM, Bokaro, Jharkhand.

It is observed that the solitary reason for the petitioner approaching this Court is that the head office of the respondent-ONGC situates within the territorial jurisdiction of this Court. Additionally, it is seen that the petitioner also assails the policy of the ONGC.

At the outset, the Court is of the prima facie opinion that this Court does not have the territorial jurisdiction to entertain the instant petition in view of the decision by Kusum Ingots v. Alloys Ltd. v. Union of India2 7.

In view, thereof Mr. Dayan Krishnan, learned senior counsel seeks liberty to withdraw the petition with further liberty to approach the jurisdictional High Court.

Leaving all rights and contentions, the petition stands dismissed as withdrawn.
