This writ petition has been filed under Article 226 of the Constitution read with Section 528 of Bharatiya Nyaya Sanhita ('BNS'), 2023 seeking grant of parole on the ground that the petitioner's marriage has been scheduled for 20.02.2025 with his recently widowed sister-in-law's. 2.
It is stated though an application for parole was duly filed to the Jail Superintendent, however, no reply was received compelling the petitioner to file the present writ petition.

Learned Additional Standing Counsel for the State submits that status report dated 17.02.2025 has been filed, and the factum of a scheduled wedding has been verified.

shows that the petitioner has been earlier granted parole in November, 2024 and he has duly surrendered.

In view of the above, the present petition is allowed and the petitioner is directed to be released on parole for a period four (4) weeks, subject to the following conditions:
a.
The petitioner shall furnish a personal bond in the sum of ₹10,000/- with one surety of the like amount, who shall be a family member of the petitioner, to the satisfaction of the Jail Superintendent;
b.
The petitioner shall contact the SHO of the local area, once a week on every 2nd and 4th Sunday at 10:00 AM and shall not leave Delhi during the period of parole. The SHO will ensure that Petitioner is not kept waiting for more than an hour. c.
The petitioner shall furnish his mobile number to the Jail Superintendent as well as to the SHO of the concerned Police Station on which he can be contacted if required. The said mobile number shall be kept active and operational at all times by the petitioner;
d.
The petitioner shall not indulge in any criminal activity during the period of parole;
e.
Immediately upon the expiry of period of parole, the petitioner shall surrender before the concerned Jail Superintendent on or before the 29th day of his release;
f.
During this period, the other co-accused persons will not be released on parole/furlough.
