O R D E R

% 20.12.2018 Mr. Narinder Kumar, Additional Sessions Judge (Central), Tis Hazari Courts, Delhi, by his report dated 14.12.2018, has confirmed that the appellant had deposited an amount of Rs.1,00,000/- (Rupees One lakh) with the trial court on 24.05.2002 vide receipt formally issued with reference to complaint case no. 160/2002 of the second respondent. In view of the statements made by both parties on 07.12.2018, the offence under Section 138, Negotiable Instruments Act, 1881, which was subject matter of criminal complaint case no. 160/2002 is treated as having been lawfully compounded.

In the consequence, the impugned judgment dated 21.05.2002 and the order on sentence dated 23.05.2002 are set aside. The appellant is acquitted.

CRL.A. 450/2002

The trial court shall release from above deposit Rs. 75,000/- to the second respondent Mahender Singh son of Hari Singh, the complainant of the said case, refunding the balance Rs. 25,000/- to the appellant Jaggan Singh, son of Indraj Singh.

The appeal is disposed of in above terms.
