Applicant seeks Regular Bail in FIR No.491/2023 dated 06.06.2023 registered at P.S. Welcome for offences under Section 323/376D/377/506, IPC and Section 6 of Protection of Children From Sexual Offence (POCSO) Act, 2012.

The prime most reason given by the applicant is to the effect that evidence of the prosecutrix is completely shaky and wavering and, in her initial-most deposition, she did not come up with any allegation with respect to commission of rape upon her. It is also apprised that all the material public witnesses have already been examined.

After some arguments, learned counsel for the applicant, without prejudice to his rights and contentions, does not press the present bail application. application afresh at a later stage.

The application is, accordingly, disposed of as not pressed. 5.

Simultaneously, since the material public witnesses, including the prosecutrix, have already been examined, the learned Trial Court shall make best endeavour to dispose of the matter, as expeditiously as possible. 8.

Learned Addl. P.P. for the State states that he would convey the message to his counterpart before the learned District Court to ensure that the remaining witnesses are summoned and examined as expeditiously as possible and assures that there would not be any delay or inaction on their part.

A copy of this order be sent to learned Trial Court for information and due compliance.
