O R D E R
% 07.12.2016 Perusal of the order sheet dated 02.12.2016 reveals that the counsel appearing for the appellant had no instructions from the appellant to pursue the appeal. Accordingly, bailable warrants for securing the presence of the appellant were directed to be issued and served through the SHO of the concerned Police Station. In response to the aforesaid order, the SHO of Police Station Kotwali has submitted his report to the effect that one Mr. Raja Bhargawa son of the appellant - Laxman Prasad Bhargawa informed the SI Bacchu Singh (who was sent to serve bailable warrants on the appellant) that the appellant has been expired on 11th Oct 2016. In support of the factum of death of the appellant, the SHO has also enclosed copy of the death certificate of the appellant - Laxman Bhargava, issued by the NDMC, Govt. of NCT of Delhi.
In view of the aforesaid facts and circumstances, since the appellant has expired and the factum of his death has also been verified by the SHO Police Station Kotwali, the present appeal filed against the appellant stands abetted and is disposed of as such. P.S.TEJI, J DECEMBER 07, 2016 pkb
