O R D E R

The present petition has been filed by the petitioner being aggrieved by the suspension of the Aadhar Card in the name of Baby Anaysha Panchal, who is born out of the wedlock between the petitioner and the respondent no.3.

It is submitted that there is a subsisting matrimonial dispute between the petitioner and the respondent no.3. Admittedly, Aadhar Card bearing No.8399 5827 2557 was issued in the name of Baby Anaysha Panchal on 01.11.2022 wherein the name of the respondent no.3 was also reflected; the address reflected in the Aadhar Card was House No.1/4556, Ram Nagar, Mandoli Road Extension, Shahdara, North East Delhi-10032. It is submitted that the same address is also contained in the birth certificate of Baby Anaysha Panchal.

It is submitted that the suspension of the Aadhar Card No.8399 5827 2557 is pursuant to a malicious complaint filed by the respondent no.3 and/or respondent no. 4. It is submitted that a representation has been made by the petitioner on 14.05.2024 seeking appropriate relief and restoration / acquisition of the said Aadhar Card.

After some hearing, with the consent of respective counsel for the parties, the present petition is disposed of with a direction to the respondent no.2 (Deputy Director, UIDAI, Pragati Maidan, New Delhi) to decide the representation of the petitioner, after affording an opportunity of hearing to the petitioner and if necessary, also to the respondent nos.3 and 4, and thereafter pass a reasoned order.

Learned counsel for the respondent nos.3 and 4 submits and undertakes and that he will appear before the respondent no.2 as and when called upon to do so, and a sincere attempt shall be made to resolve the matter as regards issuance of an Aadhar Card in favour of Baby Anaysha Panchal.

Let the aforesaid exercise be completed within a period of eight weeks from today.

The present petition is disposed of in the above terms. 8.
In case the petitioner / respondent nos.3 and 4 are aggrieved with the outcome of the aforesaid exercise, they shall be at liberty to avail appropriate remedies under law.
