The present petition alleges wilful disobedience of the directions contained in the order dated 09.09.2024 passed in W.P.(C) 12586/2024. The said order reads as under:

"1. The Petitioner alleges that certain land mafia have grabbed the public way i.e. phirni road from Khera Khurd to Holambi Kalan in Khasra No. 70 and Public Road in Khasra No. 73 running from Bhaiya Dada to Shiv Sakti Mandir in Holambi Khurd and amalgamating the same in their private property and are constructing illegal colonies. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

2. To this effect, the Petitioner has also submitted a complaint dated 10th July, 2024 to the concerned Sub-Divisional Magistrate requesting for his intervention to stop the illegal encroachment, but to no avail.

3. Considering the above, in the opinion of the Court, in terms of the directions issued by the Division Bench in Devender v. GNCTD and in RWA Sunlight Colony v. GNCTD & Ors., Petitioner's grievance must be urged before the Special Task Force.

4. Accordingly, the present petition is disposed of with a liberty to the Petitioner to raise their grievances before the STF by filing an appropriate representation narrating their grievance. The STF shall consider the same in accordance with law.

5. With the above directions, the present petition is disposed of along with pending application."

After some hearing, with the consent of respective counsel for the parties, the following directions are issued: (i) The Delhi Development Authority (DDA) would consider the representation of the petitioner and also the communication addressed by the Special Task Force (STF) to the Dy. Director, DDA (Annexure-C) regarding alleged encroachment on Khasra No. 70 (Phirni Road from Khera Khurd to Holambi Kalan) and Khasra No. 73 (Public Road from Bhaiya Dada to Shiv Shakti Mandir, Holambi Khurd).

(ii) The concerned areas shall be inspected by the officials of the DDA to ascertain whether any encroachment / unauthorized construction exists on the public road. The said inspection shall be conducted within a period of one week from today. Thereafter, appropriate action, as may be warranted, shall be taken in accordance with law by the DDA.

(iv) In case any encroachment / unauthorized construction is found, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

the same shall be duly communicated by the DDA to the respondent no.6 / Tata Power Delhi Distribution Limited (TPDDL), who shall thereafter take appropriate action in accordance with law, under intimation to the petitioner.

(v) The above exercise shall be completed latest within a period of eight weeks from today.

The petition is disposed of in the above terms. Pending application also stands disposed of.
