The present petition is filed against the judgment dated 17.12.2024 in CA 117/2024 passed by the learned Additional Sessions Judge and judgment dated 22.11.2023 and order on sentence dated 29.02.2024 in CC/632075/2016 passed by the learned Magistrate.

By order dated 11.02.2025, this Court noted that pursuant to the order dated 17.12.2024, the petitioner executed a settlement deed dated 23.01.2025 with the complainant. 3.
As per the terms of the settlement deed the petitioner has undertaken to pay a sum of ₹85 lakhs in instalments to the complainant, which shall run till 20.09.2028. 4.
The petitioner undertook before this Court on 12.11.2025 that all the instalments will be paid by him, in accordance with The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the settlement entered into between the parties. The petitioner was directed to file an appropriate affidavit in this regard before this Court.

The affidavit in compliance of the order 12.11.2025 has been filed by the petitioner.

The petitioner undertakes that he will abide by the terms of the settlement deed dated 23.01.2025, executed between him and legal heirs of respondent no.2. He further undertakes that he shall adhere to terms and conditions and shall keep paying each instalment of a sum of ₹3.5 lakhs till 20.09.2028 as per the schedule given in the MoU. The petitioner is bound by the undertaking as deposed in the affidavit.

In view of the above, the present petition is disposed of and the CT Cases 632075/2016 is compounded. Consequently, the impugned judgment dated 17.12.2024 passed by learned Court of Sessions and impugned judgment of conviction and order on sentence dated 22.11.2023 and 29.02.2024 are set aside. 8.
The legal heirs of Respondent No.2 are at liberty to file proceedings seeking contempt of Court against the petitioner in case he violates the undertaking given by him, at any stage. 9.
The legal heirs of Respondent No.2 are also at liberty to file an application seeking revival of the present petition or initiate any other proceedings that may be permissible in law, in case of violation of undertaking.

Pending application also stands disposed of.
