This application has been moved on behalf of the appellant. 2.

We are told that since the appellant is presently located in United States for studies, the application has been moved by her sister Dr. Vrinda Sharma, in whose favour a Special Power of Attorney [SPA] has been executed by the appellant.

Issue notice.

3.1.

Ms Neha Jain, learned counsel, accepts notice on behalf of the nonapplicant/ respondent. 3.2.

Ms Jain says that she does not wish to file reply and would have no objection if the prayer made in the application is allowed. 4.

settlement, albeit on their own.

It is further averred that a written settlement agreement was executed on 23.04.2024.

Mr Sunil Magar, counsel who appears on behalf of the appellant, says that it is against the backdrop of the settlement arrived at between the parties that a prayer is made to withdraw the appeal. 7.

Accordingly, the prayer made in the application is allowed. 8.

The appeal stands dismissed as withdrawn.

We may note that on being queried, Ms Jain stated that the respondent will be filing a similar application for withdrawing his appeal i.e., MAT APP. (F.C) 43/2023.

Given this position, the Registry will list MAT APP. (F.C) 43/2023 before this Court.

MAT.APP.(F.C.) 53/2023 11.

In view of the order passed in C.M. APPL. 24678/2024, nothing further remains to be done in the appeal.

The case paper shall stand consigned to the record. 13.

Consequently, the next date of hearing i.e., 09.08.2024 shall stand cancelled.
