Applicant seeks regular bail in a case arising out of FIR No. 467/2022 dated 27.10.2022, registered at PS Badarpur, Delhi, for commission of offences under Sections 302/34 IPC.

Applicant and his co-accused are facing trial for committing murder. 3.
The prime-most contention coming from the side of applicant is that there are two eye-witnesses and one such eye witness has not identified the accused/applicant and even the evidence of the other eye witnesses is shaky, as he has not said anything incriminating in his cross-examination. 4.
Learned APP for the State appears on advance notice and on instructions received from the IO, does admit that the material public witnesses have been examined. She submits that every endeavor would be made to ensure that the trial is expedited as the rest of the witnesses are formal, related to investigational aspects.

After hearing arguments for some time, learned counsel for the applicant, without prejudice to her rights and contentions, does not press the present application at this stage with liberty to approach the Court again, in case, the trial is not expedited.
