O R D E R
% 05.04.2018 Vide proceedings dated 17.01.2018, interim bail for the period from 01.02.2018 to 15.02.2018 had been granted to the appellant qua Crl. M(Bail) 66/2018 subject to the appellant filing a bail bond in the sum of Rs.2,00,000/- with one surety of like amount to the satisfaction of Trial Court with direction that he will not leave the country that he shall not intimidate the witnesses and shall not tamper with the evidence and shall not commit any offence whatsoever.
On the date 12.03.2018, a submission was made on behalf of the CBI that the appellant, who had to surrender on 15.02.2018 had not surrendered and was absconding. A status report in relation thereto was called from the trial court and a report dated 14.03.2018 of the learned Trial Court was received which indicated that the surety bond of the surety of the appellant CRL.A. 40/2018
had since been forfeited and an amount of Rs.2 lakhs as surety bond had been deposited. It has been submitted on behalf of the CBI that the proceedings under Sections 82 & 83 Code of Criminal Procedure, 1973 were in progress which are still in progress on behalf of the CBI. In view thereof, Crl. M(Bail) 66/2018 is dismissed. The record of the present appeal in relation to the appellant Gokul Chand Aggarwal be consigned sine die and be taken up on production of the appellant by the CBI.
