This application is filed by the applicant seeking condonation of delay of 01 day in filing the present leave to appeal.

For the reasons mentioned in the application, the same is allowed. The delay stands condoned.

The present petition has been filed seeking leave to appeal against the judgement of acquittal dated 02.02.2021 passed by the learned Additional Sessions Judge, Saket, New Delhi whereby the respondent was acquitted of the charge under Section 4 of the Prevention of Children from Sexual Offences Act, 2012.

The learned Additional Public Prosecutor for the State submits that the accused himself had stated that he established consensual physical relations with the prosecutrix. that the prosecutrix was a minor of 14 years of age at the time of the incident and the consent was of no significance. 6.
