The writ petition being W.P.(CRL) 590/2024, filed by the petitioner seeking pre-mature release was disposed of by the Coordinate Bench of this Court by judgment dated 09.07.2024, noting that there is no discussion by the respondent authorities on the aspects which are relevant for considering the applications for pre-mature release.

It was noted that the order rejecting the request of the petitioner was without any application of mind and the respondent authorities were therefore directed to consider the petitioner's application afresh within a period of eight months. 3.

Petitoner's application, pursuant to the judgment dated 09.07.2024, was considered again and was rejected by order dated 09.12.2024. petition indicates that yet again the order is passed without any application of mind.

The Co-ordinate Bench of this Court by a judgment dated 01.07.2025, passed in Santosh Kumar Singh v. State (Govt. of NCT of Delhi): 2025:DHC:5138 had laid down certain parameters which shall be considered by the respondent authorities while taking decision on the application for premature release. 5.

The respondent authorities undisputedly are bound by the judgment and have to pass the orders keeping in view the decision of this Court.

In view of the above, the present petition is disposed of yet again, expecting the respondent authorities to follow the law. 7.

Needless to say that in case the respondent authorities fail to act in accordance with law, despite repeated directions of this Court, the petitioner would be at liberty to file an application seeking contempt proceedings against respondent authorities. 8.

Pending application also stands disposed of.
